General Terms and Conditions for LeapifyTech

Welcome to LeapifyTech. These general terms and conditions (hereinafter "Terms") apply to all services offered by LeapifyTech, including PC support, optimization, and website development. By using our services, you agree to these Terms.

1. Definitions

• LeapifyTech: The sole proprietorship LeapifyTech, located at Kleine Snijdersstraat 34, 9280 Lebbeke, Belgium.

• Client: Any natural or legal person who enters into an agreement with LeapifyTech or uses our services.

• Services: All services offered by LeapifyTech, including PC support, optimization, and website development.

2. Applicability

2.1 These Terms apply to all offers, quotations, work, agreements, and delivery of services by LeapifyTech.
2.2 Deviations from these Terms are only valid if expressly agreed upon in writing.
2.3 The applicability of any purchase or other conditions of the Client is expressly rejected.

3. Services

3.1 PC Support: Support and assistance with technical issues, including software problems, hardware failures, and system recovery.
3.2 Optimization: Improvement of computer and systems performance through software adjustments and system settings.
3.3 Website Development: Design and development of custom websites, including technical support and updates.

4. Quotes and Offers

4.1 All quotes and offers from LeapifyTech are non-binding unless expressly stated otherwise.
4.2 A quote or offer is valid for 30 days unless a different term is specified in the quote.
4.3 LeapifyTech cannot be held to its quotes or offers if the Client can reasonably understand that the quotes or offers, or any part thereof, contain an obvious mistake or typographical error.

5. Agreement and Cancellation

5.1 The agreement between LeapifyTech and the Client is established by written confirmation of the quote by the Client or by signing an agreement.
5.2 Cancellation of the agreement by the Client must be done in writing. In case of cancellation within 7 days before the start of the service, the Client owes 50% of the agreed amount. In case of cancellation within 24 hours before the start of the service, the Client owes 100% of the agreed amount.

6. Prices and Payment

6.1 All prices are in euros and inclusive of VAT, unless stated otherwise.
6.2 Payment must be made within 14 days after the invoice date, unless otherwise agreed.
6.3 In case of late payment, the Client is in default by operation of law, and LeapifyTech is entitled to charge statutory interest and extrajudicial collection costs.
6.4 LeapifyTech may change the prices on the website at any time. If the client pays for a service and this occurs before the price change, the price that applies before the change is valid.

7. Liability

7.1 LeapifyTech is solely liable for direct damage suffered by the Client as a result of a shortcoming attributable to LeapifyTech.
7.2 LeapifyTech is not liable for indirect damage, including but not limited to consequential damage, lost profits, missed savings, and damage due to business interruption.
7.3 The liability of LeapifyTech is in any case limited to the amount paid out by the liability insurance of LeapifyTech in the relevant case.

8. Intellectual Property

8.1 All documents provided by LeapifyTech, such as reports, advice, designs, software, etc., are intended solely for use by the Client and may not be reproduced, disclosed, or made known to third parties without prior written consent from LeapifyTech.
8.2 LeapifyTech reserves the rights and powers granted to it under the Copyright Act.

9. Force Majeure

9.1 LeapifyTech is not obliged to fulfill any obligation towards the Client if it is hindered due to a circumstance that is not attributable to fault, and neither under the law, a legal act, or accepted views in traffic falls to its charge.
9.2 Force majeure in these Terms is understood to include, in addition to what is understood in law and jurisprudence, all external causes, foreseeable or unforeseen, over which LeapifyTech cannot exert influence, but which prevents LeapifyTech from fulfilling its obligations.

10. Applicable Law and Disputes

10.1 Belgian law applies exclusively to all legal relationships in which LeapifyTech is a party.
10.2 The court in the district where LeapifyTech is located has exclusive jurisdiction to hear disputes unless the law prescribes otherwise mandatorily.

11. Amendment of the Terms

11.1 LeapifyTech is entitled to amend or supplement these General Terms.
11.2 Changes of minor importance can be made at any time.
11.3 Major substantive changes will be discussed with the Client as much as possible in advance.
11.4 The most recent version of the General Terms is always available on the website of LeapifyTech.
